PUBLIC AGREEMENT (OFFER)

FOR THE PROVISION OF SERVICES FOR ORGANIZING PARTICIPATION IN SPORTS EVENTS

Lviv, Lviv region, Ukraine, 79059,
represented by Director Ruslan Dryl, acting on the basis of the Charter,
hereinafter referred to as the Organizer,
offers an unlimited number of individuals, hereinafter referred to as the Participant,
to enter into this Public Offer Agreement (hereinafter – the Agreement) under the following terms.

1. GENERAL PROVISIONS

1.1

This Agreement is a public offer in accordance with Article 633 of the Civil Code of Ukraine and comes into force from the moment it is published on the website
https://gorun.team (hereinafter – the Website).

1.2

Acceptance (full and unconditional acceptance) of the terms of the Agreement is carried out by:

  • registering for the Event via the Website and/or
  • paying the registration fee (slot) for participation in the Event.

From the moment of acceptance, the Agreement is considered concluded between the Organizer and the Participant.

1.3 Definitions:

  • Event – a sports running event (race, meeting, trail, etc.) organized by NGO “GORUN”.
  • Registration fee – payment for participation in the Event (slot, starter pack, timing, etc.).
  • Participant – an individual who has accepted the offer.

2. SUBJECT OF THE AGREEMENT

2.1

The Organizer undertakes to provide the Participant with services for organizing participation in the selected Event, including:

  • registration;
  • starter pack;
  • route organization;
  • medical assistance (within reasonable limits);
  • finisher medal, etc.

2.2

The Participant undertakes to:

  • pay the registration fee;
  • comply with the Event rules.

3. REGISTRATION AND PAYMENT PROCEDURE

3.1

Registration is carried out through the Website https://gorun.team and includes:

  • filling out the registration form;
  • selecting a distance;
  • payment via Plata by mono (or other available methods).

3.2

The cost of the registration fee is indicated on the page of the relevant Event on the Website and may change.

3.3

Payment is made online. After payment, the Participant receives confirmation to the specified email address.

3.4

The registration fee is not a charitable donation but payment for services.

4. RIGHTS AND OBLIGATIONS OF THE PARTIES

4.1 The Organizer has the right to:

  • change Event conditions (route, timing, etc.) in case of force majeure circumstances (weather, government restrictions, etc.);
  • cancel the Event and refund the registration fee (minus actual expenses).

4.2 The Participant has the right to:

  • receive services according to the paid slot;
  • transfer the slot to another person according to the rules specified on the Website (if allowed for the specific Event).

4.3 The Participant undertakes to:

  • be of legal age or have parental/guardian consent for minors;
  • have an appropriate health condition (the Organizer is not responsible for the Participant’s health);
  • comply with safety and ethical behavior rules.

5. REFUNDS

5.1 In case of Participant withdrawal:

  • 14 days before the Event date – 100% of the registration fee is refunded (minus payment system fees);
  • less than 14 days – no refund is provided (the service is considered rendered).

5.2

In case of Event cancellation initiated by the Organizer, a full refund is provided.

5.3

Refunds are made to the bank card used for payment within 10 (ten) days from the moment of request sent to:

6. LIABILITY

6.1

The Organizer is not responsible for:

  • injuries;
  • loss of personal belongings;
  • the Participant’s health condition.

Participation in the Event is carried out at the Participant’s own risk.

6.2

Force majeure circumstances (war, weather conditions, decisions of authorities, etc.) release the Parties from liability for failure to fulfill obligations.

7. PERSONAL DATA PROCESSING

7.1

The Participant consents to the processing of personal data, including:

  • full name;
  • email address;
  • phone number;
  • photo and video materials from the Event,

in accordance with the Law of Ukraine “On Personal Data Protection” for the purposes of:

  • organizing and conducting the Event;
  • informational mailings;
  • publication of results.

7.2

Consent to personal data processing is granted indefinitely and may be withdrawn by written request.

8. OTHER TERMS

8.1

The Agreement remains valid until full fulfillment of obligations by the Parties.

8.2

Amendments and additions to the Agreement are published on the Website and come into force upon publication.

8.3

All disputes are resolved through negotiations, and if no agreement is reached – in court at the Organizer’s place of registration.
